Welcome to Heshvan Digital Media. By accessing or using our services, you agree to comply with and be bound by the following Terms of Service (“TOS”). Please read them carefully.

1. Introduction
Heshvan Digital Media provides web hosting, domain registration, website design, and maintenance services. By using our services, you agree to abide by these terms. If you do not agree, please do not use our services.

2. Services
We offer services to two main groups:
– Clients who hire us to build and host their websites.
– Developers or individuals who purchase domains and hosting services.

Clients for whom we build websites receive full access to their cPanel and website files. However, if you make any changes that break your website and you are not on a maintenance plan, you will be responsible for fixing the issue. You can however request that we resolve the said issues at a fee.

3. Maintenance & Updates
– Clients not signed up for a maintenance plan are responsible for managing their website.
– Upon yearly renewal, we update your website code for security purposes.
– Clients who sign up for our maintenance package receive ongoing updates, security patches, and fixes.

4. Backups
We take regular backups of your website files and databases for security purposes. However, clients are responsible for maintaining their own backups. Heshvan Digital Media is not liable for data loss unless caused by our direct negligence.

5. Acceptable Use
You agree not to use our services for illegal purposes, including but not limited to:
– Hosting or distributing child sexual abuse material (CSAM).
– Engaging in fraudulent, abusive, or harmful activities.
– Sending spam, phishing, or malicious content.

Violation of this policy will result in immediate termination of your account and reporting to relevant authorities.

6. Price Changes
You will be notified at least 15 days in advance of any price change.

7. Refunds and Cancellations
– Domain registration fees are non-refundable once the domain is registered.
– Hosting services come with a 30-day money-back guarantee for first-time orders only.
– If you purchased a domain and hosting together, only the hosting cost is refundable within 30 days. The domain cost is non-refundable.
– If you cancel and later decide to register a different domain, you will need to pay for the new domain separately.

8. Limitation of Liability
Heshvan Digital Media shall not be held liable for any damages resulting from the use or inability to use our services. We are not responsible for losses due to downtime, data loss, hacking, or unauthorized access unless caused by our negligence.

9. Termination
We reserve the right to suspend or terminate your account if you violate these TOS, misuse our services, or fail to make timely payments.
